Mexico Regularization Process
The Mexican government has redefined its special residency Regularization program (known as the Registro Nacional de Extranjeros or RNE). This update is crucial for anyone in Mexico with an expired visitor permit or Temporary Residency card.
Who Qualifies for the Special Regularization Program?
To be eligible under the updated March 2025 criteria, you must:
- Have entered Mexico on a visitor permit (FMM) before 2023 and never left since then; OR
- Have had a Temporary Residency permit that has since expired, and never left Mexico after its expiration.
You may apply for Temporary Residency without leaving the country if you meet these requirements.
Important Notes:
- Some immigration offices may still process applications under previous RNE criteria during the transition period.
- Entries and exits from Mexico will be verified using electronic records.
- If your records predate electronic tracking (around 2011), immigration officials may assess your eligibility on a case-by-case basis.
What is a Regularization Process?
So, the Mexico Regularization Process allows individuals with expired immigration permits to apply for legal regular status without leaving Mexico. A standard Regularization is only available for those with an expired document for less than 60 days or those without family ties to Mexican citizens or residents. However, this special program extends eligibility to individuals with permits that have expired for a longer period and waives economic solvency requirements, making it an attractive option for many foreigners residing in Mexico under expired permits.
5 Steps to Apply
This procedure must be completed inside Mexico at an immigration office.
- Visit an immigration office to request guidance if you have an expired visitor permit or Temporary Residency card.
- Ensure you have not left Mexico since your permit expired.
- Complete an online form, submit all required paperwork, and write a cover letter requesting Regularization.
- During the procedure at the INM office, you will go through an interview with an immigration officer.
- Obtain a Temporary Residency card, valid for 1-4 years.
After four consecutive years of Temporary Residency, you may apply for Permanent Residency.
Government Fees for the Regularization Procedure
Applicants must pay the following fees:
- Regularization fee: MXN 1,780
- Fine for expired permits: from MXN $2,175 to $10,860
- Temporary Residency fees: Depending on the number of years you apply for:
- 1 year: ~ MXN 5,550
- 2 years: ~ MXN 8,300
- 3 years: ~ MXN 10,780
- 4 years: ~ MXN 12,529
Important Warnings
- Do NOT tamper with your FMM (visitor permit) or passport stamps. All records are electronically stored, and any alterations could result in serious legal consequences.
- Processing Time: Some offices offer same-day service; however, you should expect a turnaround time of approximately four weeks. You cannot leave Mexico while your application is pending, or it will be voided.
- Residency Requirements: Like other residency pathways, this program does not require a minimum yearly stay in Mexico. However, all residency renewals or changes must be done in Mexico.
How Long Will This Program Last?
The Mexican government has not announced an expiration date for this unique Regularization program. However, due to current political tensions, immigration policies can change without notice, so if you qualify, it is advisable to apply as soon as possible.
